Terms of Use

About these terms

These terms govern your use of www.evear.ca. By using the site you accept them. If you do not accept them, please do not use the site. They do not govern the OViz platform, or any consulting engagement — those are covered by their own agreements.

Who we are

Evear — Hearing Healthcare Solutions ("Evear", "we", "us") is a consulting practice based in Mississauga, Ontario, Canada. You can reach us at sl@evear.ca.

This website is information, not advice

Everything on this site is general information about our services. It is not:

  • Medical, audiological or clinical advice, and it is not a substitute for professional assessment or care
  • Legal, accounting, tax, regulatory or financial advice
  • A guarantee, promise or forecast of any particular business result

Descriptions of our methodology, benchmarks and past operating experience describe what we have done and how we work. Every practice is different, and nothing here should be read as a representation of what your practice will achieve.

No consulting relationship until it is agreed in writing

Submitting the Clinic Audit form, exchanging emails, or having an introductory call does not create a consulting engagement or any professional or fiduciary relationship between us. An engagement begins only when both parties sign a written agreement setting out scope, deliverables, fees and terms.

Any figures, ranges or recommendations discussed before that point are indicative and non-binding.

Using the site

You agree not to:

  • Use the site for any unlawful purpose, or in a way that could damage or impair it
  • Attempt to gain unauthorised access to the site, its servers, or any connected system
  • Submit false information, impersonate anyone, or submit another person's details without their permission
  • Send automated, bulk or repeated submissions through the enquiry form
  • Scrape, harvest or systematically extract content, or use it to train a commercial model without written permission

We apply automated rate limiting and spam filtering to the enquiry form, and may block access where we reasonably believe these terms are being breached.

Information you submit

You confirm that information you submit is accurate and that you are entitled to provide it. Please do not submit patient health information, personal information about third parties, or anything confidential to another organisation through the enquiry form. How we handle what you do submit is set out in our Privacy Policy.

Intellectual property

The content, design, copy, graphics and code of this site, together with the Evear and OViz names and marks, belong to Evear or are used with permission. You may view, download and print pages for your own internal, non-commercial use, and quote short extracts with attribution. You may not otherwise reproduce, republish or commercially exploit any part of the site without our written permission.

Separately, and for the avoidance of doubt: work product created for a client during a paid engagement — SOPs, dashboards, campaign assets and their data — belongs to that client, as stated in the engagement agreement.

Third-party links and platforms

This site links to oviz.ca and other third-party websites. We are not responsible for the content, availability or practices of any site we link to, and a link is not an endorsement. Use of OViz is governed by the terms applying to that platform.

Availability

We aim to keep the site available and accurate, but we provide it "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any defect will be corrected, and we may change, suspend or withdraw any part of it at any time without notice.

Limitation of liability

To the fullest extent permitted by law, Evear is not liable for any indirect, incidental, consequential or special loss, or for any loss of profit, revenue, business, goodwill or data, arising out of your use of — or inability to use — this website, or reliance on anything published on it. Our total liability arising from your use of this website is limited to CAD $100.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation. This clause does not apply to liability under a signed consulting engagement, which is governed by that agreement.

Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applying there. Disputes are subject to the exclusive jurisdiction of the courts of Ontario, except that we may seek injunctive relief in any competent jurisdiction.

Changes to these terms

We may update these terms from time to time. The version published here is the one in force, and the date below shows when it last changed. Continuing to use the site after a change means you accept the updated terms.
